WalkSwap ("we," "us," "our," or "Company") operates the WalkSwap mobile application
(the "App"). This Privacy Policy explains how we collect, use, disclose, and safeguard
your information when you use our App.

practices, please do not use our App.
2. INFORMATION WE COLLECT
Information You Provide Directly:
- Name, email address, and profile information
- University affiliation
- Car information (make, model, year) if you choose to add a car
- Emergency contact information for Safe Night mode
- Health data (steps, calories) if you grant permission
Information Collected Automatically:
- Location data (GPS coordinates during walks)
- Device information (device type, OS version)
- Usage data (walks completed, features used)
- Walk history and statistics
Health Information (if connected):
- Steps taken from Apple Health or Google Fit
- Calories burned
- Distance traveled
- Heart rate data (if available)
3. HOW WE USE YOUR INFORMATION
We use the information we collect to:
- Provide and improve the WalkSwap App
- Track your walks and calculate money saved
- Display your progress toward goals
- Calculate environmental impact (CO₂ saved, trees planted)
- Enable social features (leaderboards, friend connections)
- Send notifications and reminders
- Comply with legal obligations
- Prevent fraud and security issues
- Respond to your support requests
4. SHARING YOUR INFORMATION
We do NOT sell your personal data. We may share information with:
- Service providers who help us operate the App (Firebase, Google Maps, etc.)
- Universities (if you're part of a campus partnership) - anonymized aggregate data only
- Law enforcement if required by law
- Third parties with your explicit consent
Anonymous Data:
We collect and display anonymized aggregate data showing:
- Global money saved by all WalkSwap users
- Trees planted equivalent
- Total user count
- University-level statistics (anonymized)
Your individual walk data is private and never shared without permission.
5. DATA SECURITY
We implement appropriate security measures to protect your personal information:
- Encrypted data transmission (HTTPS/SSL)
- Secure cloud storage (Firebase)
- Access controls and authentication
- Regular security audits
However, no method of transmission over the internet is 100% secure. We cannot
guarantee absolute security.
6. YOUR RIGHTS
You have the right to:

- Correct inaccurate data
- Delete your account and all associated data
- Export your data in a portable format
- Opt-out of non-essential communications

7. DATA RETENTION
- Walk data: Retained until you delete your account
- Health data: Synced with your Health app; deleted when you disconnect or delete account
- Account data: Deleted within 30 days of account deletion request
- Server backups: Retained for up to 90 days for recovery purposes
8. CHILDREN'S PRIVACY
WalkSwap is intended for users aged 18 and older. We do not knowingly collect
personal information from children under 18. If we discover we've collected data
from a child under 18, we will delete it immediately.
9. THIRD-PARTY LINKS
Our App may contain links to third-party websites and services (Google Maps,
Apple Health, LIME, Veo, etc.). We are not responsible for their privacy practices.
Please review their privacy policies before sharing information.
10. CHANGES TO THIS PRIVACY POLICY
We may update this Privacy Policy periodically. We will notify you of material
changes by updating the "Last Updated" date and sending you an email notification.

TERMS OF SERVICE FOR WALKSWAP

1. ACCEPTANCE OF TERMS
By downloading, accessing, or using the WalkSwap mobile application (the "App"),
you agree to be bound by these Terms of Service ("Terms"). If you do not agree to
these Terms, do not use the App.
WalkSwap ("Company," "we," "us," "our") reserves the right to modify these Terms
at any time. Continued use of the App constitutes acceptance of modified Terms.
2. LICENSE GRANT
Subject to your compliance with these Terms, we grant you a limited, non-exclusive,
non-transferable license to download and use the App for personal, non-commercial
purposes.
You may not:
- Modify or create derivative works of the App
- Reverse engineer or decompile the App
- Remove copyright or proprietary notices
- Use the App for any commercial purpose without permission
- Rent, lease, or lend the App
- Transfer your license to another person
3. USER RESPONSIBILITIES
You agree to:
- Provide accurate, current information during registration
- Maintain the confidentiality of your account credentials
- Not impersonate others or provide false information
- Not use the App for illegal purposes
- Not harass, threaten, or defame other users
- Not attempt to gain unauthorized access to the App
- Comply with all applicable laws and regulations
4. LIMITATIONS OF LIABILITY
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, express or implied,
including merchantability, fitness for a particular purpose, or non-infringement.
WalkSwap is not liable for:
- Inaccuracies in distance, time, or money saved calculations
- GPS location errors or map inaccuracies
- Interruptions, delays, or failures in app functionality
- Third-party services (Google Maps, Apple Health, Uber API, etc.)
- Injury or property damage during walks
- Loss of data or account access
- Any indirect, incidental, or consequential damages
Our total liability to you shall not exceed the amount you paid for the App
(if applicable).
5. SAFE NIGHT MODE
While WalkSwap's Safe Night mode is designed to encourage safe walking practices
and reduce drunk driving, we are not responsible for:
- Your safety during any walk
- Emergency response time or effectiveness
- Third-party emergency services
- Weather or traffic conditions
- Your decision to walk instead of using other transportation
Always use your own judgment and call emergency services (911) if needed.
6. HEALTH & SAFETY
WalkSwap is a transportation and fitness tracking app, not a medical device. We do not:
- Provide medical advice
- Diagnose or treat medical conditions
- Replace professional medical consultation
- Guarantee calorie burn accuracy
Consult a healthcare provider before starting any new exercise routine.
7. INTELLECTUAL PROPERTY
All content in the App — including logos, text, graphics, code, and designs — is
owned by WalkSwap or licensed to us. You may not use this content without permission.

8. THIRD-PARTY SERVICES
The App integrates with third-party services:
- Google Maps and Google Directions API
- Apple Health / Google Fit
- Firebase
- LIME, Veo, and other transit partner APIs
We are not responsible for:
- Changes or discontinuation of third-party services
- Third-party pricing or policies
- Third-party data collection or privacy practices
- Errors or inaccuracies from third parties

9. TERMINATION
We may terminate your account or access to the App if you:
- Violate these Terms
- Engage in illegal activity
- Harass or harm other users
- Attempt to gain unauthorized access
Upon termination:
- Your right to use the App immediately ceases
- We may delete your data (see Privacy Policy)
- Provisions that should survive termination will remain in effect
10. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless WalkSwap, its officers, directors,
employees, and agents from any claims, damages, losses, or expenses (including legal
fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any law or third-party rights
- Your disputes with other users
11. DISPUTE RESOLUTION
These Terms are governed by the laws of Colorado, without regard to conflict of law
principles.
Any disputes shall be resolved through:
1. Good faith negotiation
2. Binding arbitration (if negotiation fails)
3. Small claims court (if applicable)
You waive the right to a jury trial.
12. SEVERABILITY
If any provision of these Terms is found invalid or unenforceable, that provision
shall be severed, and the remaining provisions shall remain in effect.
13. ENTIRE AGREEMENT
These Terms, along with the Privacy Policy, constitute the entire agreement between
you and WalkSwap regarding the App and supersede all prior agreements.
